Current Responsibilities

Harold Dorbin is the project advisory leader and a senior managing consultant for Marsh Risk Consulting’s Construction Consulting Practice. Harold’s responsibilities include leading complex dispute resolution matters and developing innovative risk management systems throughout the United States and abroad. Acting as a project manager and lead expert, he is able to efficiently and effectively identify and relate relevant technical issues to the key legal principles selected by counsel, thus reducing the effort needed to assess disputes and facilitating the development of appropriate courses of action.

Experience

Harold has consulted on projects in six continents, leading numerous domestic and international claims to resolution via negotiation, mediation, lawsuit and arbitration. He has spent nearly 30 years working for owners and contractors providing services such as plant operations; project management; construction management; process design; environmental and safety engineering; multimedia permit writing; regulatory compliance administration; rule negotiation and testimony as well as consulting and HAZOP (Hazard and Operability) chairmanship. He has been responsible for the design, start up, commissioning and operation of a number of different processes and unit operations.

Harold has significant experience in the engineering and construction industries and has worked on a wide range of claims involving analyses of schedule delay; disruption and acceleration; scope responsibility; change orders; contract reviews; costs; productivity and inefficiency; causation; project management performance; differing site conditions; measured mile; business interruption; termination and fraud. He has extensive experience throughout all phases of litigation including discovery and depositions and has provided expert testimony on International Chamber of Commerce (ICC) and American Arbitration Association (AAA) matters as well as a number of trial settings.

Harold has extensive experience drafting and negotiating numerous types of contracts and financial instruments. Harold’s engagement experience has included assessments of pre-design work; review/consulting on contract forms and advising/analysis on project delivery methods; constructability reviews; estimation of project-capital cost submittals; catalog cuts and means; bidding activities; project start-up and operations; project management; construction management; scheduling; value engineering’ contract administration; procurement; quality assurance and errors and omissions. He has also performed ISO 9000 and other audits, strategic planning, technical issue evaluations and forensic engineering.

In the risk management arena, Harold’s experience includes project governance reviews, claims prevention, project risk assessment, project risk management training/audits and the development of corporation-wide risk management programs for multi-national corporations and public and private entities. His experience in project analysis and audits spans many countries, several industries and total installed cost values, with individual project values exceeding US$30 billion. He has performed project analyses at the project conception, feasibility study, project tender development, estimate, tender submittal, contract negotiation, execution and claim stages. His risk management engagement and training expertise includes design of corporate-wide project governance programs, work scope preparation, claims prevention, project risk management, scope management, design/procurement procedure analysis and construction procedure analysis.
