On Wednesday, March 28, 2012, experts from Marsh, Skadden, and Allied World held a one-hour Webcast, "Are You and Your Executives at Risk? Revitalized Use of the Responsible Corporate Officer Doctrine in the Life Sciences and Health Care Arena."
Government agencies have revitalized the use of the Responsible Corporate Officer doctrine (RCO doctrine), which holds that corporate officers may be held criminally liable regardless of whether they had actual knowledge of the wrongdoing or participated in the offensive conduct.
Neither intent nor negligence is required for a criminal conviction, which can result in fines, imprisonment, and debarment/exclusion from working with federal health care programs.
Panelist discussed:
- the evolution of the RCO doctrine its implications;
- the increased use of the RCO doctrine today and what that may mean for corporate officers and executives;
- the legal ramifications of an RCO violation to your organization and corporate officers; and
